Terms of use

In short: GoldNah connects people who want to buy or sell gold and other precious metals. We are not a party to any deal, we do not handle payments, and we verify neither goods nor people. You trade at your own responsibility.

1. Provider and scope

The provider is Boyan Breznishki (sole developer), Vasil Levski 44, 2140 Botevgrad, Bulgaria (see Legal notice). These terms apply to your use of the GoldNah app and its website.

2. What we provide

GoldNah is a classifieds and contact platform for precious metals. It lets you publish listings, contact interested people, chat with end-to-end encryption and rate each other after a meeting.
Sales contracts are made solely between users. We provide no escrow or payment service, and we do not verify authenticity, quality or origin of goods, nor the identity or creditworthiness of users.
Ratings and reputation are not guarantees.
We may develop or change the app and discontinue individual features.

3. Account

You must be at least 18 years old.
You sign in with a username and password. Keep both, and your recovery key, safe. We cannot reset your password; without password and key, access to the account and to old chats is lost.
You are responsible for all activity under your account. One account per person; circumventing limits with additional accounts is not allowed.

4. Rules for listings and conduct

Offers must be lawful. Stolen, counterfeit or unlawfully obtained goods, fraud, money laundering, misrepresenting authenticity or weight, and any circumvention of legal requirements are prohibited.
You are responsible for complying with the laws that apply to you, e.g. on tax, customs, trade licensing and anti-money-laundering.
Your information must be truthful. No insults, harassment, threats or spam.
Upload only photos and content you have the rights to and that do not infringe the rights of others.
Safety at meetings: choose a busy public place, tell someone, inspect the goods before paying, and never hand over money or goods without checking first. If in doubt, walk away.

5. Your content and moderation

Your content remains yours. You grant us the right to display and store it within the app. Users can report content and people. We may remove listings and restrict or ban accounts if rules are broken or there is reasonable suspicion.

6. Free of charge, voluntary support

GoldNah is free. There is one account type for everyone, with limits that keep the market fair and running costs low (e.g. active listings, photos, open chats, deal confirmations, promotions). The app shows the current limits and your usage under Profile. We may adjust the limits.
You can support GoldNah with a voluntary contribution (see Support). A contribution is a gift: it unlocks no features, creates no claim to any service and is not linked to your account. GoldNah is not a registered charity; contributions are not tax-deductible.

7. Availability

We aim for reliable operation but cannot promise uninterrupted availability. Spot prices in the app are indicative and are not investment advice.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under product liability law. For slight negligence we are liable only for breach of essential contractual obligations and limited to foreseeable, typical damage. Otherwise liability is excluded. We are not liable for deals between users, their goods, payments or meetings.

9. Termination

You can delete your account at any time (see Delete account). We may ban or delete an account for violations.

10. Privacy

How we process data is described in the privacy policy.

11. Changes to these terms

We may change these terms for a valid reason (e.g. new features or legal changes). We announce material changes in the app. If you keep using GoldNah after they take effect, the new terms apply; you can delete your account beforehand.

12. Final provisions

Bulgarian law applies. Mandatory consumer protection rules of your country of residence remain unaffected. If a provision is invalid, the rest stays in force.

Nutzungsbedingungen

Kurz gesagt: GoldNah bringt Menschen zusammen, die Gold und andere Edelmetalle kaufen oder verkaufen wollen. Wir sind nicht Partei eines Geschäfts, wickeln keine Zahlungen ab und prüfen weder Ware noch Personen. Du handelst auf eigene Verantwortung.

1. Anbieter und Geltung

Anbieter ist Boyan Breznishki (Einzelentwickler), Vasil Levski 44, 2140 Botevgrad, Bulgarien (siehe Impressum). Diese Bedingungen gelten für die Nutzung der App GoldNah und der zugehörigen Webseite.

2. Unsere Leistung

GoldNah ist ein Kleinanzeigen- und Kontaktportal für Edelmetalle. Wir ermöglichen es, Anzeigen zu veröffentlichen, Interessenten zu kontaktieren, verschlüsselt zu chatten und einander nach einem Treffen zu bewerten.
Kaufverträge kommen ausschließlich zwischen den Nutzern zustande. Wir bieten keinen Treuhand- oder Zahlungsdienst, prüfen keine Echtheit, Qualität oder Herkunft der Ware und keine Identität oder Bonität der Nutzer.
Bewertungen und Reputation sind keine Garantie.
Wir können die App weiterentwickeln, ändern oder einzelne Funktionen einstellen.

3. Konto

Du musst mindestens 18 Jahre alt sein.
Du meldest dich mit Benutzername und Passwort an. Bewahre beides sowie deinen Wiederherstellungsschlüssel sicher auf. Wir können dein Passwort nicht zurücksetzen; ohne Passwort und Schlüssel bleibt der Zugang zu Konto und alten Chats verloren.
Du bist für alle Aktivitäten unter deinem Konto verantwortlich. Pro Person ist ein Konto vorgesehen; das Umgehen von Limits mit Zweitkonten ist nicht erlaubt.

4. Regeln für Anzeigen und Verhalten

Angebote müssen rechtmäßig sein. Verboten sind gestohlene, gefälschte oder unrechtmäßig erlangte Waren sowie Betrug, Geldwäsche, Täuschung über Echtheit oder Gewicht und jede Umgehung gesetzlicher Vorgaben.
Du bist selbst dafür verantwortlich, die für dich geltenden Gesetze einzuhalten, z. B. zu Steuern, Zoll, Gewerbe und Geldwäscheprävention.
Deine Angaben müssen wahrheitsgemäß sein. Keine Beleidigungen, Belästigung, Bedrohung oder Spam.
Lade nur Fotos und Inhalte hoch, an denen du die Rechte hast und die andere nicht in ihren Rechten verletzen.
Sicherheit bei Treffen: Wähle einen belebten, öffentlichen Ort, sag jemandem Bescheid, prüfe Ware vor der Zahlung und übergib Geld oder Ware nie ohne vorherige Prüfung. Bei Zweifeln brich das Geschäft ab.

5. Deine Inhalte und Moderation

Deine Inhalte bleiben deine. Du räumst uns das Recht ein, sie im Rahmen der App anzuzeigen und zu speichern. Nutzer können Inhalte und Personen melden. Wir dürfen Anzeigen entfernen, Konten einschränken oder sperren, wenn Regeln verletzt werden oder ein begründeter Verdacht besteht.

6. Kostenlos, freiwillige Unterstützung

GoldNah ist kostenlos. Es gibt eine Kontoart für alle, mit Begrenzungen, die den Markt fair und die Betriebskosten niedrig halten (z. B. aktive Anzeigen, Fotos, offene Chats, Handelsbestätigungen, Hervorhebungen). Die aktuellen Limits und deine Nutzung zeigt die App unter Profil. Wir können die Limits anpassen.
Du kannst GoldNah mit einem freiwilligen Beitrag unterstützen (siehe Unterstützen). Ein Beitrag ist eine Schenkung: Er schaltet keine Funktionen frei, begründet keinen Anspruch auf eine Leistung und wird nicht mit deinem Konto verknüpft. GoldNah ist kein gemeinnütziger Verein; Beiträge sind nicht steuerlich absetzbar.

7. Verfügbarkeit

Wir bemühen uns um einen zuverlässigen Betrieb, können aber keine ständige Verfügbarkeit zusagen. Spotpreise in der App sind indikativ und keine Anlageberatung.

8. Haftung

Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei Verletzung von Leben, Körper oder Gesundheit sowie nach dem Produkthaftungsgesetz. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und begrenzt auf den vorhersehbaren, typischen Schaden. Im Übrigen ist die Haftung ausgeschlossen. Für Geschäfte zwischen Nutzern, ihre Ware, Zahlungen und Treffen haften wir nicht.

9. Beendigung

Du kannst dein Konto jederzeit löschen (siehe Konto löschen). Wir können ein Konto bei Verstößen sperren oder löschen.

10. Datenschutz

Wie wir Daten verarbeiten, steht in der Datenschutzerklärung.

11. Änderungen dieser Bedingungen

Wir können diese Bedingungen ändern, wenn ein sachlicher Grund besteht (z. B. neue Funktionen oder Rechtslage). Wesentliche Änderungen kündigen wir in der App an. Nutzt du GoldNah nach Inkrafttreten weiter, gelten die neuen Bedingungen; du kannst dein Konto vorher löschen.

12. Schlussbestimmungen

Es gilt bulgarisches Recht. Zwingende Verbraucherschutzvorschriften deines Wohnsitzstaates bleiben unberührt. Sollte eine Bestimmung unwirksam sein, bleibt der Rest wirksam.
